Terms of Service

Himitsu (“the Service”, available at himitsu.chat) is operated by Gaon Prime, Corp. (“we”, “us”). By using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must have reached the age of majority in your jurisdiction to use the Service and enter into these Terms. By using the Service, you represent that you meet this requirement.

2. AI Service and Fictional Content

The Service lets you browse and chat with AI characters. All characters and character images are fictional and AI-generated. They are not real people. AI responses are automated, fictional, and may be inaccurate or unexpected. The Service is for entertainment only and does not provide medical, legal, financial, mental-health, or other professional advice.

3. Accounts

You sign in with a supported login provider (such as Google). You are responsible for your account and for all activity under it. Keep your login credentials secure and provide accurate information.

4. Your Content and AI Output

You keep ownership of the content you submit (messages, prompts, profile information, character settings, images). You grant us a license to host, process, display, transmit, and use it as needed to operate, protect, and improve the Service. To the extent we hold rights in AI-generated output from your threads, you may use that output for personal, non-commercial purposes.

5. Prohibited Conduct

You may not use the Service for illegal, harmful, abusive, or rights-infringing content or conduct. In particular, you may not create, request, share, or attempt to generate:

• Sexual or suggestive content involving minors, or involving characters presented as or appearing to be minors — including fictional, animated, or AI-generated depictions. We apply zero tolerance: violations lead to immediate termination and, where required, reports to authorities.
• Non-consensual sexual content.
• Sexual content depicting real, identifiable persons, including deepfakes or impersonation of real people.
• Photorealistic sexual imagery, as further described in our content rules.
• Harassment, threats, doxxing, hate, or exploitation.
• Malware, spam, scraping, automated bulk access, or attempts to circumvent safety systems, access controls, or usage limits.
• Content that infringes third-party rights.

6. Moderation and Enforcement

We may remove content, restrict features, or suspend or terminate access if we believe these Terms, the law, safety rules, or third-party rights may be violated. To report content, contact official@himitsu.chat.

7. Copyright Complaints (DMCA)

If you believe content on the Service infringes your copyright, send a notice to official@himitsu.chat including: (a) identification of the copyrighted work; (b) identification and location of the allegedly infringing material; (c) your contact information; (d) a good-faith statement that the use is not authorized; (e) a statement, under penalty of perjury, that the notice is accurate and you are authorized to act; and (f) your physical or electronic signature. We may remove reported material and may terminate repeat infringers.

8. Paid Features

Paid features are not active unless clearly shown at checkout. Joining a waitlist is not a purchase. If paid features launch, additional payment, refund, cancellation, or subscription terms will be posted.

9. Privacy

Our Privacy Policy explains how we collect, use, share, and retain information.

10. Disclaimer

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied.

11. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages. Our total liability for claims relating to the Service is limited to the greater of USD 100 or the amount you paid us in the three months before the claim.

12. Indemnification

You will indemnify and hold us harmless from claims arising out of your content, your use of the Service, or your violation of these Terms.

13. Termination

We may suspend or terminate the Service or your access at any time for the reasons described in these Terms. You may stop using the Service at any time and may request account deletion.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, except where mandatory local law requires otherwise. Disputes will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction.

15. Changes

We may update these Terms by posting a new version with a new “Last updated” date. If changes are material, we will provide reasonable notice. Continued use means you accept the updated Terms.

16. Language

These Terms are written in English. Translations, if any, are provided for convenience only; the English version governs.
